These Terms and Conditions ("Terms") govern your use of the WAVE XV CLUB website and online store and any purchase you make from us. By using the website or placing an order, you agree to these Terms. Nothing in these Terms excludes or limits any consumer right that cannot lawfully be excluded under South African law.

2. Eligibility and customers under 18
If you are under 18, you should use this website and make purchases only with the involvement and permission of a parent or legal guardian. Where required by law, a parent or legal guardian must consent to the transaction and to the processing of the minor's personal information.
3. Products, drops and availability
WAVE XV CLUB operates a small-batch, drop-based model. Products are released in limited quantities and may sell out without being restocked.
We make reasonable efforts to display product descriptions, images, colours, materials and sizing accurately. Screen settings can affect how colours appear, and minor variations can occur in small-batch or hand-finished garments, including embroidery or print placement. These minor variations do not limit your rights where goods are defective or do not meet the standards required by law.
We may limit quantities per order or customer during high-demand drops where reasonably necessary.
4. Pricing, currency and payment
All prices are displayed in South African Rand (ZAR). Delivery charges and any other applicable charges are disclosed before payment.
WAVE XV CLUB is not currently VAT registered. We reserve the right to change prices for future orders, but a price change will not affect an order already accepted at the confirmed price.
Payments are processed securely by third-party payment providers made available at checkout. We do not store your full payment-card details ourselves. An order is not treated as paid until the payment provider confirms successful payment.
5. Orders and order acceptance
After placing an order, you should receive an order confirmation. An automated confirmation means that we have received your order; it does not prevent us from correcting a genuine stock, pricing or system error where permitted by law.
If we cannot fulfil an order because the goods are unavailable, we will notify you and refund amounts paid within the period required by applicable law.
6. Changes and cancellations
If you need to change or cancel an order before dispatch, contact us as soon as possible. We will try to assist, but we cannot guarantee that an order can be stopped once fulfilment or courier arrangements have begun.
This does not limit any cooling-off or cancellation right you may have under the Electronic Communications and Transactions Act or other applicable law. See our Return and Refund Policy.
7. Shipping and delivery
We currently deliver within Cape Town and Stellenbosch. Delivery fees, delivery methods, timing, failed deliveries and address requirements are explained in our Shipping Policy.
8. Returns, exchanges and refunds
Returns, exchanges and refunds are handled in accordance with our Return and Refund Policy and applicable South African law, including statutory rights that cannot be excluded.
9. Intellectual property
Unless otherwise stated, the WAVE XV CLUB name, branding, logos, artwork, product graphics, photography, written content and other original site content are owned by or licensed to WAVE XV CLUB and are protected by applicable intellectual-property laws.
You may not reproduce, distribute, sell, commercially exploit or create derivative commercial works from our branding, artwork or content without prior written permission, except where permitted by law.
10. Acceptable use
You agree not to use the website for unlawful purposes, attempt to interfere with its security or operation, introduce malicious code, misuse another person's information, or knowingly provide false or misleading information when placing an order.
11. Third-party services
Our store is hosted by Shopify and may use third-party payment, delivery, analytics, marketing and technology providers. Those providers may process information necessary to provide their services. Their own terms and privacy notices may also apply to their services.
12. Privacy
Our collection and use of personal information is described in our Privacy Policy. Please review it before using the Services or providing personal information to us.
13. Website availability and liability
We aim to keep the website accurate, secure and available, but we do not guarantee uninterrupted access or that every error will be immediately corrected. To the maximum extent permitted by law, WAVE XV CLUB will not be liable for indirect or consequential loss arising solely from circumstances beyond our reasonable control.
Nothing in these Terms limits liability or consumer remedies that cannot lawfully be excluded, including rights under the Consumer Protection Act and Electronic Communications and Transactions Act.
14. Electronic records and communications
You agree that order confirmations, receipts, notices and other transaction communications may be provided electronically. Order information is sent to the contact details supplied at checkout and may also be available through your customer account where that feature is enabled.
15. Changes to these Terms
We may update these Terms from time to time. The version published on this page will apply from its stated "Last updated" date, subject to applicable law. Changes will not retrospectively remove rights that already arose under an accepted order.
16. Governing law
These Terms and transactions with WAVE XV CLUB are governed by the laws of the Republic of South Africa. Any dispute will be handled by the courts or consumer dispute-resolution bodies that have jurisdiction under applicable law.
